CONSISTE EN ENTRAR EN LA MORADA DE OTRA PERSONA, SIN SU CONSENTIMIENTO YA SEA EN SU VIVIENDA HABITUAL, EN SU SEGUNDA RESIDENCIA O EN SU CASA DE VACACIONES<\/li><li>DELITO DE USURPACION: ES ENTRAR EN UN INMUEBLE QUE NO EST\u00c1 OCUPADO, COMO PUEDE SER UNA CASA ABANDONADA, UN LOCAL VACIO\u2026<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">EN ESTE CASO, HEMOS SALIDO DE NUESTRO JUICIO BASTANTE CONTENTAS, Y HEMOS SOLICITADO QUE SE DICTE SENTENCIA UNA SENTENCIA CONDENANDO POR UN DELITO DE USURPACION DEL ARTICULO 245.2 CP, QUE SE ORDENE EL DESALOJO INMEDIATAMENTE, Y UNA RESPONSABILIDAD CIVIL CONSISTENTE EN ABONAR POR LA OKUPA LAS FACTURAS LUZ Y AGUA Y DEMAS GASTOS QUE HAN TENIDO QUE SOPORTAR LOS PROPIETARIOS<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">EN <a href=\"https:\/\/provisional.com.es\/toscanolex\/contacto\/\">TOSCANOLEX<\/a>, SOMOS ESPECIALISTAS EN DERECHO INMOBILIARIO (TANTO TEMAS CIVILES COMO PENALES), POR LO QUE.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"> SI NECESITA ASESORAMIENTO O AYUDA PARA ECHAR A SUS OKUPAS, NO DUDE EN CONTACTAR CON <a href=\"https:\/\/www.instagram.com\/toscanolex\/?next=%2F&amp;hl=es\">NOSOTROS<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Judgement against okupas<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Today we had one against okupas, in THE COURTS OF TORREMOLINOS.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this kind of cases it is important to know whether to use the civil or the criminal route, and the great difference between the both is:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; V\u00eda civil: it is when there is a consent to entry to the property, either through a written contract or verbal agreement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8211; Criminal proceedings: crime of &nbsp;breaking and entering, or crime of usurpation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 the crime of breaking and entering: it is a more serious crime. Consists of entering the dwelling of another person, without their consent, whether in their usual home, in their second residence or in their vacation home<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u2022 crime of usurpation: it is entering a property that is not occupied, such as an abandoned house, an empty premises&#8230;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this case, we have come out of our judgment quite happy, and we have requested that a judgment be issued convicting for a crime of usurpation of article 245.2 cp, that the eviction be ordered immediately, and a civil liability consisting of paying for the okupa the electricity and water bills and other expenses that the owners have had to support<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At toscanolex, we are specialists in real estate law (both civil and criminal issues).
