{"id":8522,"date":"2021-02-15T17:13:09","date_gmt":"2021-02-15T17:13:09","guid":{"rendered":"http:\/\/provisional.com.es\/toscanolex\/somos-pioneros-sentencias-estimatorias-por-las-reclamaciones-de-gastos-de-formalizacion-de-hipoteca\/"},"modified":"2021-02-15T17:13:09","modified_gmt":"2021-02-15T17:13:09","slug":"somos-pioneros-sentencias-estimatorias-por-las-reclamaciones-de-gastos-de-formalizacion-de-hipoteca","status":"publish","type":"post","link":"https:\/\/provisional.com.es\/toscanolex\/somos-pioneros-sentencias-estimatorias-por-las-reclamaciones-de-gastos-de-formalizacion-de-hipoteca\/","title":{"rendered":"SOMOS PIONEROS \/ SENTENCIAS ESTIMATORIAS POR LAS RECLAMACIONES DE GASTOS DE FORMALIZACI\u00d3N DE HIPOTECA."},"content":{"rendered":"<div class=\"post_text_inner\">\n<h3><b>SENTENCIAS ESTIMATORIAS POR LAS RECLAMACIONES DE GASTOS DE FORMALIZACI\u00d3N DE HIPOTECA.\u00a0 Sentencias Clausulas Suelo.\u00a0<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">El Tribunal Supremo dict\u00f3 Sentencia de fecha 23 de diciembre 2015, por la que fallaba que la cl\u00e1usula contenida en los pr\u00e9stamos hipotecarios por las que se cargaba con todos los gastos de la constituci\u00f3n de la hipoteca al consumidor <\/span><b>ERA NULA.<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Los gastos de formalizaci\u00f3n de hipoteca, deben de ser abonados en gran parte por las entidades bancarias, y no por el cliente.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Es cierto que, desde que se dictara dicha Sentencia, cada Juzgado y Audiencia, a lo largo de Espa\u00f1a, han dictaminado resoluciones diferentes, en cuanto a la cantidad a devolver por los Bancos (Notar\u00eda, Registro, Impuesto, gestor\u00eda\u2026)<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A fecha de 17 de diciembre de 2017,\u00a0se hab\u00edan presentado m\u00e1s de 150.000 demandas<\/span><b>\u00a0<\/b><span style=\"font-weight: 400;\">contra los bancos de nuestro pa\u00eds. Para poder hacer frente a los pleitos relacionados con las cl\u00e1usulas hipotecarias. El pasado 1 de enero se incrementaron en casi medio centenar el n\u00famero de jueces dedicados a este asunto y entraron en funcionamiento 77 nuevos juzgados especializados.<\/span><\/p>\n<p>\u00a0<\/p>\n<p><span style=\"font-weight: 400;\">El 90% aproximadamente de las demandas son estimadas. Da lo mismo que se trate de una hipoteca ya cancelada, subrogada o que haya sufrido novaciones\u2026<\/span><\/p>\n<p>\u00a0<\/p>\n<p><span style=\"font-weight: 400;\">En concreto, en M\u00e1laga, el Juzgado especializado en Cl\u00e1usulas Suelo y Gastos Hipotecarios. La tendencia que est\u00e1 siguiendo es la de:<\/span><\/p>\n<p>\u00a0<\/p>\n<p><strong>-Declaraci\u00f3n de nulidad de la cl\u00e1usula que obliga al consumidor a abonar todos los gastos por la formalizaci\u00f3n del pr\u00e9stamo hipotecario.<\/strong><\/p>\n<p><strong>-Devoluci\u00f3n de lo abonado por notar\u00eda, registro y parte de gestor\u00eda<\/strong><\/p>\n<p><strong>-Condena en costas al banco<\/strong><\/p>\n<p>\u00a0<\/p>\n<h5><span style=\"font-weight: 400;\">Nosotros, desde <\/span><a href=\"https:\/\/provisional.com.es\/toscanolex\/servicios\/abogado-inmobiliario-torremolinos\/\"><b>TOSCANOLEX<\/b><\/a><span style=\"font-weight: 400;\">, \u00a0queremos no solo hacernos eco de estas noticias, si no impulsar a todos aquellos que se hayan visto afectados por esta situaci\u00f3n a reclamar.<\/span><\/h5>\n<p>\u00a0<\/p>\n<p><b>Somos un claro ejemplo de lucha contra la imposici\u00f3n arbitraria de estos gastos;<\/b><span style=\"font-weight: 400;\"> tal es as\u00ed que desde nuestro despacho <\/span><a href=\"https:\/\/provisional.com.es\/toscanolex\/despacho\"><b>TOSCANOLEX<\/b><\/a><span style=\"font-weight: 400;\">, situado en Torremolinos (M\u00e1laga), ha sido posible la <\/span><b>CONSECUCI\u00d3N DE SENTENCIA FAVORABLE<\/b><span style=\"font-weight: 400;\">, <\/span><b>DE LAS PRIMERAS EN NUESTRA LOCALIDAD<\/b><span style=\"font-weight: 400;\">, por parte del Juzgado 18 Bis de M\u00e1laga; \u00a0acordando la nulidad de la condici\u00f3n general impuesta por la entidad bancaria, como as\u00ed la correspondiente reclamaci\u00f3n de cantidad (notar\u00eda, registro y parte de gestor\u00eda , mas intereses y costas).<\/span><\/p>\n<p>\u00a0<\/p>\n<p><span style=\"font-weight: 400;\">Por ello, no dude ponerse en contacto con nosotros.
